Chief Resident Magistrate (South), Paul Chiotcha, has discharged 34 year-old Police Officer, Victor Kachingwe, who was accused of alleged rape of a convicted woman who was on remand at Lunzu Police Unit at the time of the alleged commission of the offence.
Counsel Bentry Nyondo of Ritz Attorneys -at- Law who was representing the accused said the State’s application followed its realization that the prosecution of his client would yield nothing but waste state resources
“This was a moonlight prosecution from the very beginning, and I am glad my Client has been discharged from prosecution” said Nyondo.
In his short oral ruling made in Open Court Magistrate Chiotcha said:
'This is a proper case where the State should be allowed under Section 81 (a) of the Criminal Procedure and Evidence Code Act to withdraw their case if they believe that further prosecution is not warranted,'
The accused is a detective sergeant at Lunzu Police Unit, which is under Chileka Police Station.
Kachingwe comes from Ken in the area of Traditional Authority Kapeni in Blantyre.
